QLD:No change to Jayant Patel sentence
BRISBANE, April 21 AAP - Queensland's Court of Appeal has dismissed Dr Jayant Patel's
appeal against his seven-year sentence for manslaughter and causing grievous bodily harm.
In July 2010 Patel was jailed for seven years after a jury found him guilty of the
manslaughter of Gerry Kemps, 77, James Phillips, 46, and Mervyn Morris, 75, while he was
working as a surgeon at Bundaberg Hospital.
He was also found guilty of causing grievous bodily harm to Ian Rodney Vowles, 62.
The court also dismissed the attorney-general's appeal calling for a tougher sentence.

FED:Jailed Australian not a spy says wife
The wife of an Australian citizen who has been in jail in China for five years insists
he is not a spy.
JAMES SUN has spent the past five years in prison in China .. with two years on death
row .. after being convicted of being a spy for Taiwan.
Fairfax newspapers report he's now serving a life sentence in Beijing Prison No.2.
His wife says her husband's confession was concocted and he's never been to Taiwan
and doesn't know anyone there.
Mrs SUN has now gone public with his case .. which Fairfax reports the Australian government
has known about since 2006 .. hoping he can be brought home to serve his sentence under
a 2007 treaty with China for the repatriation of prisoners.
But the Australian government has not passed the enabling legislation.

CANBERRA, Aug 23 AAP - One of the independents who may end up a parliamentary kingmaker
has warned he will not tolerate any lying from a new government.
It's not yet clear whether Labor or the Liberals will end up with the most seats, or
who will form a government with the help of the crossbenches.
Independent Andrew Wilkie, who is tussling with Labor for the lineball Tasmanian seat
of Denison, said it was not true he would automatically support Labor.
"I've got a clean sheet of paper in front of me at the moment," the left-leaning Mr
Wilkie told ABC Television on Monday night.
He said that, if elected, he would side with the party best placed to offer "stable,
competent and ethical government" - not necessarily the party with the most seats.
"In the acts of lying and so on, I won't accept that and I won't support legislation
in that regard," he said.
Another potential kingmaker, West Australian National Tony Crook, is counted as a coalition
member but has said he'd act as an independent.
"If we need to step outside of the coalition, we're prepared to do that, and if we
need to step outside of the party room we'll do the same thing," Mr Crook told ABC Television.
When asked if he would sign up to a deal with the coalition and support them on all
laws, Mr Crook said: "Not at all".
The WA Nationals were an independent political party, he said.
Another kingmaker MP, the Greens' Adam Bandt, said he would meet other independents
in Canberra on Tuesday to get to know them.
He told ABC Television he was inclined to support Labor because they were more progressive,
and flagged that he would move in the House of Representatives on gay marriage, asylum
seekers, and putting a price on carbon.

CANBERRA, April 16 AAP - The United States is set to provide key combat units to support
Australian troops as the Dutch withdraw from Oruzgan province, Defence head Air Chief
Marshal Angus Houston says.
Air Chief Marshal Houston said discussions with US Admiral Jim Stavridis this week
were preliminary and the plan is yet to be considered by either the US or Australian governments
or NATO.
He said someone needed to replace the Dutch who had provided key enabling forces used
by Australian troops in Afghanistan.
"The intent is to replace the combat enablers with American forces. That is quite logical
and probably what I would have expected," he told journalists.
Australian currently has some 1550 troops in Afghanistan, most in Oruzgan province.
Since deploying into Oruzgan in 2006, Australian troops have operated under overall
Dutch control, relying on Dutch transport and attack helicopters, jet bombers, heavy artillery,
hospital and much more.
In October, the Netherlands government voted not to extend its mission in Afghanistan.
The government collapsed following a disagreement between coalition partners over Afghanistan
with no election anticipated for some months.
Despite hopes that the Dutch might reconsider or allow some units to stay, that's now
unlikely, with the withdrawal expected to begin by August.
Air Chief Marshal Houston said United States President Barack Obama announced last
year the US would commit an additional 30,000 troops to Afghanistan and those set to go
to Oruzgan would come from that number, not in addition to it.
He said Admiral Stavridis, commander of US European Command and NATO supreme commander,
expressed total satisfaction with Australia's contribution and was eager to help resolve
issues arising from the Dutch withdrawal.
"He did give an undertaking that American forces would come in to provide the combat
enabling part of the requirement."
Air Chief Marshal Houston said the Australian government had continually rejected any
lead role for Australia and that was unlikely to change.
"But in terms of commanding the forces in the oruzgan battlespace across the board,
that is something that we are talking to NATO about," he said.

Green and business groups today found themselves in a rare alliance .. celebrating
the defeat of the government's planned emissions trading scheme in the Senate.
STEVE CAMPBELL .. from Greenpeace .. says the ETS would have been ineffective .. and
was never going to decrease Australian emissions.
The Australian Environment Foundation and Friends of the Earth agree .. but are calling
for an urgent back-up plan.
And the Minerals Council of Australia says the government should now be looking at
a scheme which reduces emissions .. supports new technologies and protects the competitiveness
of Australia's export sectors.
The council's MITCHELL HOOKE says the government's scheme failed to do any of these.

Vic: Vic police warn drivers to take care after five deaths

MELBOURNE, April 24 AAP - Speed, wet weather and inattention contributed to five deaths
across Victoria in a horror 24 hours on the state's roads, police say.
Victoria Police Assistant Commissioner Ken Lay pleaded with Victorians to take care
over the Anzac Day weekend to ensure no more lives were lost.
Mr Lay said it had been a "black day" for the state.
"We've lost five people in the last 24 hours and we've got another person fighting
for their life in hospital," he told reporters in Melbourne on Friday.
"Speed, wet roads and inattention seem to be the main contributing factors."
A man in his mid-30s was killed about 3pm (AEST) on Friday when the car he was travelling
in ran off the road, into a culvert and hit a tree.
The driver, in his 40s, was flown to The Alfred hospital in a serious condition.
The accident happened on Woori Yallock Road in Nangana, east of Melbourne.
Earlier, a woman died and another was seriously injured when their car smashed into
a tree on the Princes Highway, about three kilometres east of Swan Reach, in the state's
southeast about 10.30am.
A 53-year-old woman died and two other women, aged 45 and 47, were injured when a car
ran off the Hume Freeway at Wallan and rolled early on Friday.
In another crash, about 5pm on Thursday, a 36-year-old truck driver died in hospital
after his small fruit truck collided with a B-double truck near Shepparton on the Goulburn
Valley Highway.
Only half an hour later, an 11-year-old girl died when she was hit by a Ford utility
as she tried to cross a road at Berwick, in Melbourne's outer southeast.
The crashes take Victoria's road toll to 102, compared to 104 for the same time last year.
With wet weather set to continue over the weekend, and many people expected to enjoy
a drink on Anzac Day, police are "bracing" themselves, Mr Lay said.
"We've got the wet roads, we've got the potential for people to be out there drinking
as well, and that is always a recipe for disaster."

Eds: Reissuing to correct that the accident occurred on Thursday
MELBOURNE, Dec 19 AAP - A woman has been killed after her car was struck by a trailer
that had disconnected from a car in Victoria's north-west.
Police said an Isuzu utility was towing a fruit bin trailer when it came loose and
started swerving from side to side, about 8pm (AEDT) on Thursday, on Woorinen Road, in
Swan Hill.
The trailer disconnected from the ute, crossed over to the wrong side of the road and
collided with the driver's side of a Mazda sedan.
The driver of the Mazda, a 30-year-old Swan Hill woman, suffered severe injuries and
was pronounced dead at Swan Hill hospital and her 28-year-old female passenger was treated
for shock.
The driver of the ute, a 37-year-old Swan Hill man, has been assisting police with
their inquiries.
The fatality takes Victoria's road toll to 294, compared to 316 for the same time last year.

that box - twice.
"I'm pretty lucky, I came here with a goal to achieve - an individual medal - and I've
got two of them so I'm very happy," she told the Seven Network.
She said the race went to plan and she would head back to training with plenty to work on.
"That was pretty much the plan, just take it out and try and hold on," she said.
"I've definitely learnt a lot from this meet and I have something to work on I suppose
for the future."

Vic: Thousands without power until Monday
MELBOURNE, April 5 AAP - Thousands of Victorians will still be without power this weekend,
as the struggle continues to restore services in the wake of Wednesday's wild storms.
About 20,000 of the 420,000 homes whose supply was knocked out by the storms remained
cut off last night, most of them in Melbourne's eastern suburbs.
Power companies SP AusNet and Alinta say it will take all weekend to reconnect everyone.
"We're not anticipating completing all the work we've got to do until into Monday,"
said Alinta's Scott Parker.
The Victorian government yesterday came under attack, with privatisation of the power
industry being blamed on the delay in reconnecting residents.
But Energy Minister Peter Batchelor said Victoria had suffered the biggest "wind event"
in its history.
The State Emergency Service (SES) has appealed for those affected by the storms to
help ease the backlog by doing some of the clean-up themselves.
But WorkSafe urged Victorians to take extreme care, particularly when using power tools,
ladders and hired equipment.
WorkSafe executive director John Merritt says many people carrying out their own clean-up
work such as clearing gutters or cutting up fallen trees have to be aware of the risk
of serious injury if precautions are not taken.

NSW: Drink-drive numbers soar with party season
SYDNEY, Dec 3 AAP - The start of the Christmas party season has coincided with a sharp
increase in the number of people caught drink-driving in southern NSW.
At the start of the second week of a national crackdown known as Operation RAID, police
say they already have charged 80 people with drink-driving offences in the state's south.
More than 12,000 breath tests have been carried out in the region as part of the operation.
Of those charged, 36 have had their licences suspended for returning blood-alcohol
readings of 0.08 or above and/or exceeding the speed limit by more than 45km/h.
The apprehensions account for 80 per cent of all charges laid since the crackdown began
on November 23.
Police also are testing for drug-affected drivers as well as those who have drunk too
much alcohol.
Senior-Sergeant Mick Timms said drug-drivers should be aware they are on the radar.
"This week seven people found out how serious we were about this when they were stopped
in a roadside drug-testing operation at Coolac (north-east of Wagga Wagga)," Senior Sgt
Timms said.
"Many people are getting into office party season and we are reminding them to have
a good time and leave the car at home."

SYDNEY, Dec 19 AAP - The exodus of one million Australians seeking work overseas is
not a national brain drain but a brain gain, says federal Treasurer Peter Costello.
Launching the inaugural Advance 100 Leading Global Australians Summit in Sydney today,
Mr Costello said it was in the national interest for Australians to work overseas.
The Advance summit brings together 100 prominent expatriate Australians from business,
the public sector and the arts, including astronaut Andy Thomas, Royal Ballet principal
Leanne Benjamin, comedian Clive James, author Kathy Lette and former foreign minister
Gareth Evans.
"Sometimes you hear the criticism of this country that skilled Australians are going
overseas to work," Mr Costello told delegates.
"This criticism is nonsense.
"Young talented Australians overseas are not a loss to this country, they are a great
national asset."
After learning new skills and gaining invaluable overseas experience, research showed
a high proportion of expatriates returned to Australia for family and retirement, 75 per
cent within two years of leaving.
Australians who went to the UK to work had a return rate of 85 per cent, Mr Costello said.
Of the one million expatriates living and working abroad, one-quarter was in the United
Kingdom and Ireland, another quarter in continental Europe, one-seventh was in North America
and the remainder in the Asia-Pacific.
These were typically young, highly educated, highly skilled people who cited employment
opportunities and professional development as the greatest reason for moving offshore,
Mr Costello said.

Qld: Two dead in horror day on roads
BRISBANE, Aug 11 AAP - Two men are dead and four other people have been injured in
a horror day on Queensland roads.
Police say an elderly man was killed and three other people were taken to hospital
after an accident at Rockhampton, on the central Queensland coast.
Two cars collided at the intersection of Yaamba and Richardson Roads at north Rockhampton
just before 11.30am (AEST).
Another man was killed and a woman seriously injured when their vehicle rolled on the
Bruce Highway at Kallangur, on Brisbane's northern outskirts around 2pm (AEST).
A third man also died in hospital today after an accident last Friday on Brisbane's northside.
Police said 57-year-old Leonard James Harker from Chermside was trapped underneath
his car when he tried to stop it from rolling backwards down his driveway onto Rode Road
at Chermside.
He was pinned beneath the vehicle before being freed by emergency services workers
and rushed to hospital in a critical condition.

Vic: Schoolgirl rescued after falling ill in rugged high country
MELBOURNE, April 5 AAP - A schoolgirl was airlifted to a Melbourne hospital today after
falling ill on a school excursion in a rugged area of Victoria's high country.
Rural ambulance and State Emergency Service crews in four-wheel drives were sent to
Mount King Billy, in the Alpine National Park east of the Mount Buller ski resort, about
1.30pm (AEST) to rescue the girl, a Rural Ambulance Service spokeswoman said today.
The 14-year-old girl, who was suffering abdominal pain and had become unconscious,
was winched to a waiting air ambulance and was taken to the Royal Children's Hospital,
a State Emergency Service spokeswoman said.
The SES vehicle, with three volunteers aboard, was sent to clear trees from tracks
leading to the scene.

Proposed Security Rules Generate Positive Reviews.
Although the federal government has done a good job drafting proposed rules to govern the security of all electronic health data, some regulations, especially those governing audit trails, need clarification. That's the early reaction of some industry observers who are developing detailed comments on the proposed rules for the U.S. Department of Health and Human Services.
The department proposed the security rules--required under the Health Insurance Portability and Accountability Act of 1996--on August 12 and will accept comment through October 13 before drafting final rules (see September issue, page 12).
HHS has succeeded in telling the industry what it must do to protect electronic health data without forcing it to use specific technologies to protect the data, observers say.
"The rules are reasonable because they are scalable and technology neutral," says William Miaoulis, information security officer for the University of Alabama Health System, Birmingham.
"The approach is appropriate and doesn't limit us to technology that might be obsolete by implementation time," adds Chuck Meyer, informatics standards liaison for HBO & Co., Atlanta.
Enough time?
But with final rules expected in early 1999 and effective two years later (three years for very small health plans), the industry may not have enough time to complete implementation, especially as it straggles with the year 2000 problem.
"Two years is too quick to have ultimate security in health care," Miaoulis says. "The banking industry took longer than that to have security."
Extending the security regulations' effective date to three years after publication of final rules would give the industry enough time to comply, says Shannah Koss, government and health care program manager for IBM Corp., Armonk, N.Y.
While the security rules pertain to health care providers, payers and claims processors, a lot of the technical work will fall on information systems vendors, Miaoulis says. Unfortunately, he adds, vendors "haven't cared a lick about audit trails and other security features."
Meyer responds that HBOC and other major vendors are aware of the security rules and are taking the necessary steps. "Many providers expect their vendors to take care of things like this. But if your vendor is small, they may not be aware of it, and you may have to get involved."
But the workload doesn't fall solely on vendors, Miaoulis warns. "Some health institutions started years ago on security," he says. "But many have lots of work to do."
While applauding a thoughtful approach from HHS, a first read of the proposed rules raises some concerns that the department needs to address in the final rules, some observers say. For example, the rules require the use of audit trails, but don't specify how extensive the trails should be to determine who has had access to what types of information.
Most audit trails are "exception" trails--they flag inappropriate or suspect access to information, Koss of IBM says. Capturing too much data on who is accessing what types of health information could endanger patient privacy, she adds.
For instance, in a paper environment, a consulting physician signs in at the records department and gets access to records of the patient on whom he is being asked to consult. But audit trails in an electronic environment can track that a physician pulled up specific records, or the trails can track that he searched among specific records, then identify which records he pulled up and examined. "If you have to capture which records he looked at, then the audit trail shows the view of the record he looked at," Koss says. "For audit purposes, someone else has to look at that record. The record now is more vulnerable because it has been duplicated."
Encryption concerns
The requirement that information transmitted over the Internet be encrypted also is a concern because that might involve technology that isn't widely used in health care today, Koss says.
For example, if the Internet is used to transmit health information in a store-and-forward environment between organizations, that involves encryption with a public-private key system. That requires the organizations transmitting and receiving the information to use the same key system, which requires use of a digital certification authority.
"The infrastructure for assigning these keys doesn't exist today in health care," Koss says.
Other areas that observers want HHS to take a close look at before drafting final rules include:
* Extending the security requirements to faxed data.
* Clarifying who will enforce civil penalties for intentional misuse of health identifiers.
* Clarifying pre-emption of state laws. Rules pertaining to digital signatures would preempt state laws, but many of the other rules may not.
* Making the regulations less bureaucratic for small provider organizations by, for instance, recognizing that the smallest physician practices don't need to develop training manuals.
* Giving small provider organizations the same additional year to comply that small payers are given.
Diamond Offshore Announces Second Quarter 2011 Results.
HOUSTON -- Diamond Offshore Drilling, Inc. (NYSE:DO) today reported net income for the second quarter of 2011 of $266.6 million, or $1.92 per share on a diluted basis, compared with net income of $224.4 million, or $1.61 per share on a diluted basis, in the same period a year earlier. Revenues in the second quarter of 2011 were $889.5 million, compared with revenues of $822.6 million for the second quarter of 2010.
For the six months ended June 30, 2011, the Company reported net income of $517.2 million, or $3.72 per share on a diluted basis, compared with net income of $515.2 million, or $3.70 per share on a diluted basis, for the same period in 2010. Revenue for the six months ended June 30, 2011 was $1.7 billion, essentially identical with $1.7 billion for the first six months of 2010.
In addition, in the past 45 days the Company has put in place 10 new agreements that are expected to generate combined maximum total revenue of approximately $1 billion and represent over 14 years of contract drilling backlog. Significant among these agreements:
* Petrobras has given notice of its intent to exercise a right to convert the Ocean Baroness and Ocean Valor contracts from three years to five years, in return for which the Company will lower each dayrate by $10,000. The two rigs are expected to earn additional combined maximum total revenue of approximately $500 million, excluding any potential performance bonus payments.
* The Company has reached agreement with OGX to extend both the Ocean Quest and Ocean Star contracts in Brazil by one year. The extensions are expected to result in combined maximum total revenue of approximately $200 million.
* The Ocean Yorktown has received a letter of award for a 930-day contract with Pemex in Mexico commencing mid-November 2011 that is expected to earn maximum total revenue of approximately $171 million. The unit is currently under contract to Petrobras in Brazil, but under mutually agreed terms will demobe to Mexico as soon as practical. The remaining days of the Yorktown contract with Petrobraswill be added to the Ocean Concord contract.
* The jack-up Ocean Summit has received a letter of award for a 985-day contract with Pemex in Mexico commencing in late February 2012 that is expected to earn maximum total revenue of approximately $85 million.
* The jack-up Ocean Titan has received a letter of award for a 777-day contract with Pemex in Mexico commencing in mid-November 2011 that is expected to earn maximum total revenue of approximately $80 million.
Diamond Offshore provides contract drilling services to the energy industry and is a leader in deepwater drilling.
Maximum contract revenue as stated above assumes 100% rig utilization. Generally, rig utilization rates approach 95-98% during contracted periods; however, utilization rates can be adversely impacted by additional downtime due to unscheduled repairs, maintenance and weather.
